MeltMed, Inc. (“MeltMed”, “we”, “us” or “our”) respects the privacy of our visitors and customers (referred to as “you” or “your”). This privacy policy (and as amended from time to time as posted on our website here) (“Privacy Policy”) and, for California residents our California Privacy Notice, describes the types of information we may collect from you or that you may provide when you visit or use our meltmed.com website (“Website”), or purchase our products (“Products”), as well as our practices for collecting, using, maintaining, protecting, disclosing, retaining, and transferring that information. This Privacy Policy applies to the data collected by us, or those working on our behalf, through information you enter through the Website. It does not apply to data collected through other websites, products, or services not approved by us.
WHAT INFORMATION DOES THIS PRIVACY POLICY COVER?
This Privacy Policy covers our treatment of personal information. “Personal Information” means any unencrypted or non-deidentified information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with a particular person such as, but not limited to, your name, mailing address, email address, telephone number, etc. Please see additional information below on the particular information we may collect. Personal Information does not include your Personal Information that has been deidentified, pseudonymized, anonymized, aggregated, and/or otherwise processed so as to be unidentifiable in such a way that the data can no longer be attributed to a specific individual (by reasonable means) without the use of additional information, and where such additional information is kept separate and under adequate security to prevent unauthorized reidentification of a specific individual such that one could not, using reasonable efforts, link such information back to a specific individual (collectively, all of the foregoing in this sentence being referred to as “De-Identified Personal Information”). Personal Information also does not include information related to businesses, companies, institutions, or other entities rather than individuals (“Business Information”). We do not consider Business Information, such as title, employer’s name, work email, work phone number, work address, and other similar business information, to be Personal Information. We may also collect Personal Information from you through means other than our Website. It may also include emails, text messages, or other electronic communications that you send to us separate from our Website or by way of our third-party service providers. However, if we combine the Personal Information we collect from you outside of our Website with Personal Information that is collected through our Website or by another means as described above, the Privacy Policy will apply to the combined information, unless specifically disclosed otherwise. Other than as stated herein, this Privacy Policy does not apply to information collected by any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on our Website. We are not responsible for the practices of sites linked to or from our Website, and before interacting with any of these sites you are advised to review their rules and policies before providing them with any private information.
INDIVIDUALS UNDER THE AGE OF 21
We do not knowingly collect, solicit or maintain Personal Information from anyone under the age of 21 or knowingly allow such persons to purchase our Products. If you are under 21, please do not send any Personal Information about yourself (such as your name, address, telephone number, or email address) to us. In the event that we learn that we have collected Personal Information from someone under age 18 we will use commercially reasonable efforts to delete that information from our database. CHANGES TO OUR PRIVACY POLICY
We may change this Privacy Policy from time to time as well, so you should visit our Privacy Policy Website page periodically to check for updates. The current version of this Privacy Policy can always be found under the Privacy Policy link on the Website. You can tell if there have been changes to the Privacy Policy by checking the “last Updated” or “Effective” date at the top of that page. If you use the Website or purchase Products after any changes to the Privacy Policy have been posted, that means you agree to the new Privacy Policy, including all of the changes. Information Collected Indirectly from You
When you visit our Website, we may collect information about your visit and maintain that information in our web server logs, which are records of the activities on our Website. The servers automatically capture and store the information electronically. Examples of the information we may collect include: Internet Protocol (IP) address; browser type and language; Internet Service Provider (ISP), referring and exit websites and applications; websites viewed while on the Site; operating system; date/time stamp of activity; clickstream data; whether you are a first-time or a returning user; links you clicked on while in the Website; and your flow and navigation path through the Website. We use this information in a deidentified and aggregated fashion to help us administer the site, analyze its usage, protect the website and its content from inappropriate use, and improve your Website experience.
In some parts of our Website and through email messages, you will find a “click-through URL” linked to content on our Website. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. IP Address. Our servers (or those of our service providers) automatically record certain log file information reported from your browser when you access the Website. These server logs may include information such as which pages of the Website you visited, your internet protocol (“IP”) address, browser type, and other information on how you interact with the Website. These log files are generally deleted periodically.
Pixel Tracking. In addition to using Cookies, the Website may employ “pixel tracking”, a common process which may be used in connection with advertisements on other sites. Pixel tracking involves the use of pixel tags that are not visible to the user and consist of a few lines of computer code. Pixel tracking measures the effectiveness of advertisements and compiles aggregate and specific usage statistics. A “pixel tag” is an invisible tag placed on certain pages of websites that is used to track an individual user’s activity. We may access these pixel tags to identify activity and interests that may allow us to better match our Products, services, and offers with your interests and needs. For example, if you visit our Website from an advertisement on another website, the pixel tag will allow the advertiser to track that its advertisement brought you to the Website. If you visit our Website, and we link you to another website, we may also be able to determine that you were sent to and/or transacted with a third-party website. Website Analytics
We use third-party website analytics software from third-party providers [e.g., Google Analytics] in connection with our Site to gather data such as age, gender, and interests to provide advertising targeted to suit your interests and preferences.
You may opt out of the automated collection of information by third-party ad networks for the purpose of delivering advertisements tailored to your interests, by visiting third party pages and using their opt out methods.
This analytics software helps us target our online ads based on information collected directly from you or by automated means, like cookies. These companies also use automated technologies to collect information when you click on our ads, which helps track and manage the effectiveness of our marketing efforts.
Meltmed utilizes analytics software provided by Google Analytics. Google collects information associated with the Website (like information about your browser, network, and device, web pages visited before and during your view of the Site, and your IP address) that is not used to identify a user. This information helps us better understand how visitors use our Website, detect and defend against fraud and other security risks, and present advertisements, products, and/or services of interest to you. Information We Collect From Third Parties
We may collect information that others provide about you when you use the Website or obtain information from other sources and combine that with information we collect through the Website.
- Third Party Services. If you link, connect, or login to your account with a third-party social media service (e.g., Facebook, Google, Instagram, Yelp, etc.), the third-party service may send us information such as your registration and profile information from that service. This information varies and is controlled by that service or as authorized by you via your privacy settings at that service.
- Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as demographic data or fraud detection information, from third party service providers and/or partners, and combine it with information we have about you. For example, we may receive background check results or fraud warnings from service providers like identity verification services for our fraud prevention and risk assessment efforts. We may receive information about you and your activities on and off the Website through partnerships, or about your experiences and interactions from our partner ad networks. Other examples of such providers include, but are not limited to, backend processing, fulfillment, and automation, email management, authentication, form processing, website usage tracking, managing calendar invites and scheduling, and database hosting and management.
Third-Party Use of Cookies and Other Tracking Technologies
Some content or applications, including advertisements, on the Website are served by third parties, including advertisers, ad networks and servers, content providers and application providers. Children’s Information
Our Website is not directed at children. We do not knowingly collect Personal Information from children under the age of 21. We may use your Personal Information you provide us and which we obtain from other sources to better understand your interests so we can try to predict what other Products, services and information you might be most interested in. We only use your Personal Information for the original purposes it was given and to further our legitimate interests, such as to enroll members in our organization, provide information about our organization and services, and to communicate with Site visitors. Personal Information is used also to provide you with a more enjoyable, convenient online experience. We may use your Personal Information to send you requested information, to personalize content for you, to compile, analyze, and better understand user data, demographics and behavior, and to detect, investigate, and prevent activities that may violate our policies or be illegal. Our employees and agents may view your Personal Information to perform their jobs and address your needs. We authorize their access to your Personal Information on a need-to-know basis to provide you with information or services, or for one of the other reasons listed in this section, and always in connection with a contractual obligation to protect the privacy of that information.
We also provide your Personal Information to Touchsuite Systems, LLC a third-party vendor who partners with us to operate our payment system on the Website. Touchsuite Systems, LLC may be given the Personal Information identified above to allow us to complete your purchases of products or services. Touchsuite Systems, LLC uses that information only to complete your purchases and orders and is hosted for internal purposes.
We may also use information you provide to us to communicate with you in the future. If you do not wish to receive such communications, you may opt out (unsubscribe) as described below in the “Access and Consent to Use of Your Personal Information” and “Questions and Contact Information” section.
Disclosure of Your Information
We will not sell, rent, or lease any information we collect from you to others. We will not make your Personal Information available to any unaffiliated parties, except as follows:
- To employees, contractors, agents, website vendors, and/or contractors who may use it on our behalf or in connection with their relationship with us;

In the event of an insolvency, bankruptcy, or receivership, your Personal Information may also be transferred as a business asset.
In addition, we may share aggregate, non-individual information, incapable of identifying a person, with third parties for lawful purposes. We will not disclose any of your Personal Information except when we have your permission or under special circumstances, such as when we believe in good faith that the law requires it or under circumstances described in this Policy.
Access and Consent to Use of Your Personal Information

EMAIL MARKETING
You agree that we may send you marketing emails. We are committed to keeping your e-mail address confidential and will not disclose your email address to any third parties except as allowed in the information use and processing section or for the purposes of utilizing a third-party provider to send such emails. We will maintain the information sent via e-mail in accordance with applicable laws and regulations. In compliance with the Controlling the Assault of Non-Solicited Pornography and Marketing (CAN-SPAM) Act, all e-mails sent from us will clearly state who the e-mail is from and provide clear information on how to contact the sender. You may opt-out of receiving marketing-related emails, targeted advertising messages, or promotional offers from MeltMed by clicking the "unsubscribe" link at the bottom of any email you receive from us or emailing us at customer.care@meltmed.com.
If you opt-out from receiving marketing emails or text messages, we may still need to send you communications about your account, membership, and other matters. If you do not agree to receive future marketing communications directly from a third party through our Site, you will need to contact that party to opt-out of such communications. This process may be outlined on that party's privacy policy. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Your California Privacy Rights
If you are a California resident, you may have certain rights with respect to your Personal Information including the following rights:
- The right to know, by way of our Policy and any specific inquiries you direct to us, where Personal Information we have about you comes from, what we use that information for, whether it is being disclosed or sold, and to whom it is being disclosed or sold;
- The right to have access to any Personal Information we have in our possession or control regarding you;
- The right to “opt-out” of MeltMed’s sale or sharing of your Personal Information to any third parties and to “opt-out” of any automated decision making or profiling;
- The right, with some exceptions, to have your Personal Information deleted from MeltMed’s possession or control;
- The right to receive equal service and pricing from MeltMed even if you exercise any of your privacy rights
- The right to correct inaccurate personal information;
- The right to receive your Personal Information to allow it to be moved to other companies; and
- The right to restrict the processing of sensitive Personal Information.
California Civil Code Section 1798.83 permits users of the Site who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. A California resident may also use an authorized agent to submit a right to access request or a request to delete. Virginia Residents

- To confirm whether or not MeltMed is processing your Personal Information and to access such Personal Information;
- To correct inaccuracies in your Personal Information, taking into account the nature of the Personal Information and the purposes of the processing of the Personal Information;
- To delete your Personal Information;
- To obtain a copy of your Personal Information that you previously provided to MeltMed in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the Information to another controller without hindrance, where the processing is carried out by automated means; and
- To opt-out of the Personal Information processing for purposes of targeted advertising, the sale of personal Information, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
MeltMed will respond to any of the above requests within forty-five days. MeltMed may extend this deadline once by an additional forty-five days when reasonably necessary, taking into account the complexity and number of your requests, so long as we inform you of the extension within the initial forty-five-day response period along with the reasons for the extension. Should you choose to, you may appeal the decision not to take action (or to take limited action) by submitting an appeal within fourteen days of receipt of MeltMed’s initial response to the following:
Within sixty days of receipt of your appeal, MeltMed shall inform you in writing of any action taken or not taken, in response to the appeal, including a written explanation of the reasons for the decisions. Colorado Residents
If you are a Colorado resident, you may, upon request, have certain rights with respect to your Personal Information, including the following rights:
- To opt-out of the processing of your Personal Information for purposes of targeted advertising, the sale of Personal Information; or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you;
- To confirm whether MeltMed is processing your Personal Information and to receive access to that Personal Information;

MeltMed may extend this deadline once by an additional forty-five days when reasonably necessary, taking into account the complexity and number of your requests, so long as we inform you of the extension within the initial forty-five-day response period along with the reasons for the extension. 3) If technically feasible, to obtain a copy of data that you provided to us in a portable manner; and
4) To opt out of the processing of Personal Information for targeted advertising or sale.

Connecticut Residents
If you are a Connecticut resident, you may, upon request, have certain rights with respect to your Personal Information, including the following rights:

Indiana Residents
If you are an Indiana resident, you may, upon request, have certain rights with respect to your Personal Information, including the following rights:
- The right to confirm whether MeltMed is processing your Personal Information and request access to the same;
- The right to correct inaccuracies in the Personal Information you provided to MeltMed;
- The right to obtain a copy, or representative summary, of the Personal Information about you possessed by MeltMed in a portable and readily usable format;
- The right to delete the Personal Information that you provided to MeltMed and/or data otherwise obtained about you by MeltMed;
- The right to opt out of the processing of your Personal Information for targeted advertising, profiling, and of the selling of your Personal Information; and
- The right, as a parent or on behalf of a user known to be a child, to prevent the processing of sensitive data (as that term is defined by statute) about that child unless and until that parent or person on their behalf provides consent.

Montana Residents
If you are a Montana resident, you may, upon request, have certain rights with respect to your Personal Information, including the following rights:
- The right to opt-out of the sale by MeltMed of Personal Information and the use of Personal Information for targeted marketing and profiling;
